Criminal charges vs. Cavite Rep Kiko Barzaga set for resolution -- DOJ
The criminal charges filed against suspended Cavite 4th District Rep. Francisco “Kiko” Barzaga are now ready for resolution by a panel of prosecutors of the Department of Justice (DOJ).
Barzaga filed last Friday, Jan. 23, his counter-affidavits on the charges filed by the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG).
DOJ Spokesperson Raphael Niccolo L. Martinez said that Barzaga was charged in two criminal complaints.
The charges arose from Barzaga’s October 2025 Facebook post that expressed support to the calls for the Mindanao secession and the anti-President Marcos rally that he led in Forbes Park in Makati City on Oct. 12, 2025.
For his Facebook post, Barzaga was charged with inciting to sedition in violation of Article 142 of the Revised Penal Code (RPC) and inciting to rebellion or insurrection in violation of Article 138 of the RPC, as amended, in relation to Section 6 of Republic Act (RA) 10175, the Cybercrime Prevention Act of 2012.
For the protest rally, Barzaga was charged with tumults and other disturbance in public places in violation of Article 153 of the RPC; alarm and scandal under Article 155 of the RPC; and violation of Batas Pambansa 880, the Public Assembly Act of 1985.
Last December, Barzaga was suspended without pay by the House of Representatives for his Facebook posts which were described as “unbecoming of a House member.”
Several cyber libel complaints have also been filed against him. Two of the complainants are Antipolo City 1st District Rep. Ronaldo "Ronnie" Puno and billionaire businessman Enrique K. Razon Jr.
