PBBM has last say if ICC issues arrest order vs any Filipino -- DOJ
President Marcos has the last say whether the Philippine government should implement or not arrest warrants against Filipinos from the International Criminal Court (ICC), the Department of Justice (DOJ) said on Monday, March 10.

DOJ Assistant Secretary Jose Dominic F. Clavano IV pointed this out following reports that the ICC has issued an arrest warrant against former president Rodrigo Duterte who is facing charges for crimes against humanity over the killings that took place during the drugs war of his administration.
Clavano said the DOJ has already given a briefer to the President “on the pros and cons of each action, whether to respect the request of the ICC through the Interpol (International Criminal Police Organization).”
“It is up to him (the President) to interpret that and to decide which is best for our country,” he told journalists covering the DOJ,
Meanwhile, Clavano said the government, through the National Central Bureau (NCB), is ready to process should a red notice from the Interpol is issued in connection with an ICC arrest warrant.
In its website, the Interpol explained that its red notice is “not an international arrest warrant” but “a request to law enforcement worldwide to locate and provisionally arrest a person pending extradition, surrender, or similar legal action.”
“So if ever may request po sila, ang NCB po ang mag-process nun at sila na rin po ay gagalaw based on that request (So if ever the Interpol has a request, the NCB will process it and will act on the request),” Clavano explained.
But Clavano said the government has not received information that the ICC has issued an arrest warrant.
“As of today wala pa po tayong narereceive na notice (we have not received any notice) of any warrant that has been issued by the ICC,” he said.
He reminded that the Philippines has withdrawn as a signatory of the Rome Statute that created the ICC.
“The withdrawal became effective in 2019 following instructions from then President Duterte in 2018 to have the Philippines withdraw from the ICC,” he also said.
