Mother convicted of sexual abuse, exploitation of own minor daughter
A mother has been convicted for exploitation and sexual abuse of her minor daughter and sentenced to life imprisonment or a maximum of 30 years in jail by the Quezon City regional trial court (RTC).
In a decision issued by RTC Judge Roslyn M. Rabara-Tria, the mother, whose name was redacted in the decision, was found guilty of violating Section 4(a) of Republic Act (RA) No. 11930, the Anti-Sexual Abuse and Exploitation of Children (OSAEC) and Anti-Sexual Abuse or Exploitation Materials (CSAEM) Act.
Aside from life imprisonment, the mother was ordered to pay a fine of P2 million.
The case stemmed from a referral letter sent by the Federal Bureau of Investigation (FBI) that was received by Philippine National Police-Directorate for Investigation and Detective Management-Women and Children Protection Center Luzon Field Unit (PNP-DIDM-WCPC-LFU) on Feb. 7, 2023.
The FBI informed the PNP that it found several Filipinas suspected engaged in OSAEC, including the convicted mother.
The United States law enforcement agency also provided the PNP the mobile phone number, PayPal account, and address of the mother who was found residing in Quezon City.
After undercover investigators contacted the mother and confirmed she provided naked photos and videos of her own minor daughter, the PNP conducted an entrapment operation last Jan. 10, 2024 at the residence of the woman that resulted in her arrest as well as her husband.
The police also rescued during the entrapment operation the couple’s 15-year-old daughter.
“In the Information (criminal charge sheet) dated Jan. 26, 2024, it was alleged that accused BBB (the mother) wilfully, knowingly, and unlawfully employ, induce or engage ‘minor AAA’, her daughter, to show her naked body and private parts and perform sexual live shows, and have them recorded by means of photos and videos, in order to create and produce CSAEM or CSAM,” said the judge in her decision.
Based on the evidence presented, the judge ruled: “The prosecution established the guilt of accused BBB beyond reasonable doubt for violation of Section 4 (a) of RA No. 11930.”
However, the husband was acquitted of the charges.
“There is no evidence on record proving that he permitted or influenced his daughter, AAA, to engage, participate or assist in any form of CSAEM,” the judge said.
