Contractor Cezarah “Sarah” Discaya has been formally served a warrant of arrest by the National Bureau of Investigation (NBI) over her alleged involvement in the flood control anomalies.
In a statement issued on Friday morning, Dec. 19, the NBI said the arrest warrant issued by Lapu-Lapu City Regional Trial Court (RTC) Branch 27 was served on Thursday night, Dec. 18, to Discaya who has been in custody since she voluntarily surrendered last Dec. 9.
“Upon arrest, Ms. Discaya underwent standard booking and documentation and will be temporarily committed to the NBI Detention Facility,” the NBI said.
“Thereafter, she will be escorted to Cebu to be formally presented before the issuing court, Regional Trial Court (RTC) Branch 27, Lapu-Lapu City, in compliance with lawful court processes,” it also said.
The non-bailable malversation of public funds and graft charges against Discaya, several officials of the Department of Public Works and Highways (DPWH) in the P96.5 million “ghost” infrastructure project in 2022 were originally filed by the Office of the Ombudsman before the RTC in Davao Occidental.
Later, the Supreme Court (SC) ordered the transfer of the cases to Lapu-Lapu City where they will be handled by a special court designated to try and resolve graft cases and those involving the flood control projects of the government.
Aside from Discaya, also charged were Davao Occidental District Engineer Rodrigo C. Larete, Assistant District Engineer Michael P. Awa, and several section chiefs, project engineers, and inspectors.
Also charged was Ma. Roma Angelin Rimando of St. Timothy Construction Corporation, a firm affiliated with Discaya.
They were charged with violations of Section 3(e) of Republic Act No. 3019, the Anti-Graft and Corrupt Practices Act, Article 217 in relation to Article 171 and 172 of the Revised Penal Code on malversation of public funds through falsification of public documents.
Those charged reportedly conspired to facilitate the release of P96.5 million for the supposed construction of a revetment project in Barangay Culaman, Jose Abad Santos, Davao Occidental.
Based on official inspection and witness accounts, the project was never implemented and there was no actual construction but the accused certified that the project was completed.
The eight DPWH officials involved have been preventively suspended for six months because of their administrative cases. The suspension order had been served by DPWH Secretary Vince Dizon when he conducted his own inspection in Davao Occidental.
