DOJ resets preliminary investigation of charges in 5 flood control cases in Bulacan
The Department of Justice (DOJ) decided to reset to Friday, Nov. 14, the scheduled preliminary investigation on Monday, Nov. 10, of the first five cases involving the “anomalous” flood control projects in Bulacan.
“We are looking at Friday provided subpoenas are all served,” said Prosecutor General Richard Anthony D. Fadullon on Sunday, Nov. 9.
The decision to reset the investigation was made after the Office of the President ordered suspension of government work and classes in the National Capital Region (NCR) and other regions on Monday due to super typhoon Uwan.
The respondents named in the five cases include former and current officials and personnel of the Department of Public Works and Highways (DPWH), namely, former district engineer Henry C. Alcantara, assistant district engineers Brice Ericson D. Hernandez and Jaypee D. Mendoza, project engineer Arjay S. Domasig, project engineer Nino Lawrence V. Morales, finance section chief Juanito C. Mendoza, administrative section chief Floralyn Y. Simbulan, cashier Christina Mae D. Pineda.
Also included as respondent was Sally No. Santos, representative of Syms Construction.
Set for preliminary investigation are charges of malversation through falsification of public documents under Article 217 in relation to Article 171 Paragraph 4 of the Revised Penal Code (RPC); perjury under Article 183 of the RPC; and graft under Section 3(e) of Republic Act No. 3019, the Anti-Graft and Corrupt Practices Act.
