Firm asks Ombudsman to dismiss Pampanga town mayor for P80-M extortion try
An administrative case has been filed against San Simon, Pampanga Mayor Abundio “Jun” Punsalan Jr. who was arrested in his attempt to extort P80 million as bribe money from a steel corporation.
The complaint against Punsalan was filed by RealSteel Corporation which accused the mayor of grave misconduct, serious dishonesty, and conduct prejudicial to the best interest of service in violation of the 2017 Revised Rules in Administrative Cases in the Civil Service (RACCS).
“The audacity of the Respondent Punsalan to violate code of ethics and anti-graft and corruption laws should be penalized,” the firm declared in the complaint filed by Irwin H Chua and Melodie E. Arellano.
Chua and Arellano asked the OMB to place Punsalan under preventive suspension while their complaint is being investigated.
After investigation, they also asked the OMB to dismiss Punsalan from the service, cancel his eligibility, forfeit his retirement benefits, and perpetually bar him from holding public office and from taking any civil service examination.
The complainants informed the OMB that Punsalan was arrested last Aug. 5 inside the Clark Ecozone in Mabalacat, Pampanga during an entrapment operation conducted by operatives of the Intelligence Service of the National Bureau of Investigation (NBI).
“The entrapment was conducted based on our formal complaint against Mayor Punsalan, who demanded an amount of Eighty Million Pesos (P80,000,000) in exchange for not revoking or causing to overturn Municipal Ordinance No. 24-0025 passed by the previous Sangguniang Bayan, which granted tax incentives to our company,” RealSteel said.
The firm added that Punsalan was caught in the act during the entrapment operation and that the media even reported the arrest of the mayor who was charged by the NBI for robbery extortion under the Revised Penal Code (RPC) and for violation of Republic Act (RA) 3019, the Anti-Graft and Corrupt Practices Act.
“The crux of this Complaint-Affidavit is the brazen use of authority of Mayor Punsalan and the public office of the municipal mayor to extort money from us for his own private gain with the illegal condition that RealSteel Corp.’s tax incentives would be taken away if Respondent’s request for money is not acceded to,” it also said.
