No order to suspend ex-president Duterte's proclamation - Comelec chief

Commission on Elections (Comelec) Chairman George Erwin Garcia said that there's currently no order to suspend the proclamation of former President Rodrigo Duterte as mayor in Davao City.
"Wala naman kasi tayong issue na kahit anong order to suspend proclamation although I think may nafile na kaso (We don’t have any issue like an order to suspend the proclamation, although I think a case has already been filed)," Garcia said in an interview.
"Di po kasi kumilos yung kaso kaka-file lang nung isang araw, kung hindi tayo nagkakamali I think it was filed nung Sabado or nung Friday. So wala pa yung raffle wala pa tayong aksyon ang division ng Comelec man lang, wala pang answer o kung anuman, and so mukhang hindi pa namin maaksyunan sa kasalukuyan (But the case hasn't progressed because it was just filed the other day—if I'm not mistaken, I think it was filed last Saturday or Friday. So there hasn’t been a raffle yet, no action from any Comelec division, no answer or anything, and so it seems we can’t act on it for now)," he added.
Garcia said that under the law, unless there is an order to suspend the proclamation of a candidate, even if there is a pending case, they can still be proclaimed.
Asked what Comelec's action will be should the International Criminal Court (ICC) bar him from taking his oath of office, Garcia said that the Department of Interior and Local Government (DILG) will be the one to handle it.
"As far as we're concerned, our responsibility only goes as far as the proclamation of a winning candidate. So once a candidate is proclaimed, Comelec’s jurisdiction ends," Garcia said.
"Whether or not that person assumes office or is able to take their oath—that’s up to the DILG, based on the Local Government Code, they are the ones in charge of such matters," he added.
Duterte has received the highest number of votes in Davao's mayoral race with 662,630 based on the official results from the Comelec.
