DOJ approves filing in court of criminal cases vs 2 Chinese POGO workers
The Department of Justice (DOJ) has approved the filing in court of qualified human trafficking and kidnap for ransom cases against two Chinese workers arrested during a raid of Lucky South 99, a Philippine Offshore Gaming Operator (POGO) in Porac, Pampanga.
In a 14-page resolution dated Aug. 30, a DOJ panel of prosecutors approved the indictment of Chinese nationals Jiang Shi Guang and Qin Ren Guo for qualified trafficking in persons under Section 6(o) of Republic Act (RA) 9208, the Anti-Trafficking in Persons Act of 2003, and kidnap for ransom under Article 267 of the Revised Penal Code (RPC), respectively.
The resolution was signed by Assistant State Prosecutor Honey Rose E. Delgado and Prosecution Attorney Ma. Lara Dominique B. Sanchez with the approving signatures of Prosecutor General Officer-In-Charge (OIC) Senior Deputy State Prosecutor Richard Anthony D. Fadullon and Deputy State Prosecutor Olivia I. Laroza-Torrevillas.
The panel released the resolution after having conducted a preliminary investigation of the complaint filed by the Philippine National Police-Criminal Investigation and Detection Group (PNP-CIDG), the Presidential Anti-Organized Crime Commission (PAOCC), and private Chinese complainants Yu Zhou Jing and Zhang Tie Zhu.
The two Chinese complainants were rescued by authorities last June 6 during a raid of the Lucky South 99 in Porac, Pampanga where they were detained.
The panel of prosecutors said all of the elements of qualified trafficking as alleged by Yu Zhou Jing against Jiang Shi Guang are there.
“Perusal of the facts would reveal that all the aforementioned elements are present. Respondent Jiang Shi Guang, in conspiracy with unidentified personalities, recruited, transported, transferred with unidentified personalities, and harbored Yu Zhou Jing. In particular, the respondent and his cohorts recruited Yu Zhou Jing, transported him to the compound of Lucky South 99 in Porac, Pampanga, and maintained and harbored him inside the said place sometime in May 2024 until 06 June 2024,” reads the resolution.
Yu Zhou Jing claimed he arrived in the Philippines in 2019 on the promise to work as a chef but found himself unwilling working as an an online scammer and his personal belongings taken from him including identification cards, passport, cellphone, and cash.
On the other hand, the panel also found the existence of all of the elements of kidnap for ransom in the allegations of Zhang Tie Zhu against Qin Ren Guo.
“Respondent Qin Ren Guo is a private individual. In conspiracy with other unidentified personalities, they kidnapped complainant Zhang Tie Zhu outside Robinsons PLace on 02 June 2024. Thereafter, respondent Qin Ren Guo and these unidentified personalities brought the private complainant to Lucky South 99 in Porac, Pampanga, where he was detained until his rescue on 06 June 2024. The detention lasted for more than three (3) days. Moreover, the kidnapping was committed for the purpose of extorting ransom in the amount of P300,000,” reads the resolution.
On the other hand, the panel recommended the dismissal of the case against Jiang Shi Guang for kidnapping and serious illegal detention under Article 267 of the RPC as well as the complaint against Qin Ren Guo for trafficking in persons, robbery and serious physical injuries.
