OSG set to file in court petition to cancel Guo's birth certificate


The Office of the Solicitor General (OSG) is set to file before a trial court today, July 5, a petition for the cancellation of the birth certificate of suspended Mayor Alice L. Guo of Bamban, Tarlac.

Solicitor General Menardo I. Guevarra said the filing of the cancellation of the birth certificate "will lay the groundwork for the subsequent filing of a petion for quo warranto" against Guo.

A quo warranto petition is a special civil action against a person who usurps, intrudes into, or unlawfully holds or exercises a public office without lawful authority to do so.

A quo warranto granted by the court would automatically unseat Mayor Guo and may be subjected to other charges.

“Today the OSG will file a petition for the cancellation of the certificate of live birth of Alice Leal Guo on the ground, among others, of failure to comply with the legal requirements for late registration,” Guevarra said.

But for security reasons, Guevarra did not disclose before which court the cancellation of the birth certificate of Guo would be filed.

Earlier, the Philippine Statistics Authority (PSA) had earlier recommended the cancellation of Guo’s birth certificate.

The PSA said it found that the filing of the documents for late registration of the birth certificates of both Guo and her supposed sibling Shiela Lea Guo was "highly irregular."
