OSG files before Tarlac City RTC petition to cancel Guo's birth certificate


The Office of the Solicitor General (OSG), on behalf of the Philippine Statistics Authority (PSA), filed on Friday afternoon, July 5, before the Tarlac City regional trial court (RTC) a petition to cancel the certificate of live birth (COLB) of suspended Mayor Alice L. Guo of Bamban, Tarlac.

“Alice’s COLB with Registry No. 2005-10757 must be canceled by the Honorable Court for being void, the same not having duly registered in accordance with law,” the OSG said in the petition.

It cited the absence of supporting documents which violates the mandatory requirements under Section 1, Rule 25 of Administrative Order No. 1-93 of the National Statistics Office (NSO), now PSA.

Apart from the NSO certificate that it has no birth record of Guo, the OSG said “no other document was submitted in support of the delayed registration of Alice’s COLB.”

“There were no baptismal certificate, school records, income tax return, insurance policy, medical records, barangay certification, or other documents which could have established Alice’s name, the date and place of her birth, and the names of her parents,” it said. 

“There was also no affidavit of disinterested witnesses who have witnesses or known about Alice’s birth,” it added.

At the same time, the OSG said it was found that her alleged father, Angelito Guo, was the one who applied for delayed registration on Nov. 22, 2005 even though she was already 19 years old at that time.

Citing Section 1(b), Rule 25 of the NSO Administrative Order No. 1-93, the OSG explained a person who is already 18 years age should be the one who should apply for late registration.

“In the present case, however, Alice was not the one who applied for the late registration of her birth,” said OSG said as it pointed out that this was a violation of the NSO administrative order.

It also found other violations of NSO Administrative Order No. 1-93 including the fact that the Local Civil Registrar (LCR) recorded the birth even though entries in the application form and the requirements were not completed; and the absence of the signature of Guo’s mother, Amelia Guo, in the COLB.

In addition to the numerous irregularities, the OSG said it was discovered that there are also “material discrepancies between the entries in Alice’s COLB and the facts established under public records.”

Among these, the OSG cited that her COLB indicated her place of birth is Matatalaib, Tarlac, Tarlac but the Barangay Matatalaib has issued a certification that there is no record of Guo nor her family.

Though Guo claimed during the Senate hearings that her father, whose Chinese name is Jiangzhong Guo, is a Chinese citizen, the OSG said the COLB indicated that her father is a Filipino.

Among the many points it raised, the OSG said Tarlac City has no records of the marriage of her parents taking place on Oct. 14, 1982 despite being indicated in the COLB.
