As the country prepares for Labor Day celebration on May 1, the Public Sector Labor-Management Council (PSLMC) on Monday, April 29, signed the 2024 Implementing Rules and Regulations (IRR) on the right of government employees to organize.
The 2024 IRR was signed by Civil Service Commission (CSC) Chairperson Karlo A.B. Nograles, Labor Secretary Beinvenido Laguesma who sits as the vice-chairperson of the PSLMC, and representatives of the other members of the PSLMC including the Department of Justice (DOJ), Department of Finance (DOF), and the Department of Budget and Management (DBM).
On June 1, 1987, the late then President Corazon C. Aquino signed Executive Order (EO) No. 180 which created the PSLMC and provided the guidelines for government employees to organize.
The PSLMC first came out with its IRR on 1989 and later issued an amended IRR on 2004.
Section 8, Article XIII of the 1987 Constitution provides: "The right of the people, including those employed in the public and private sectors, to form unions, associations, or societies for purposes not contrary to law shall not be abridged."
“The promulgation of the 2024 rules is a testament of the council’s commitment to continuously improve and safeguard the exercise of the right to self organization in the public sector,” Nograles during the signing ceremony at the DOJ in Manila.
Nograles said: "The new rules and regulations may not be absolutely perfect considering the dynamic environment that they will operate today. However, this acknowledgement should not deter us from actively engaging and shaping the trajectory of employee relations in the public sector."
“Our bottomline good employee relations is vital in advancing employee welfare and participatory governance,” he stressed.
He said the 2024 IRR incorporated the latest council policies on functioning and administration of employees organizations; the establishment of employees organization transition group; merger and consolidation of names and modes of dissolution of employees organizations; the determination of the sole and exclusive negotiating team, agent; dispute resolution; automatic accreditation of the winner in case of certification election, among others.
Also, he said the new IRR contains new provisions on consultation services; effectivity of collective negotiation agreements; and national employees organizations which have now also been recognized.
“As of February 2024 po, there are 1,992 registered public sector unions covering some 629,302 members,” Secretary Laguesma said.
Justice Secretary Jesus Crispin C. Remulla, in a message read for him by Undersecretary Frederick A. Vida, said the IRR is meant "to safeguard the rights of those who serve our country, to support their well-being and to support their invaluable contribution to our nation.”
“Government employees are the engine of our bureaucracy, the unseen hands that guide the ship of state. They translate policy into action, rights into realities, and service into progress. Their ability to organize is pivotal to a responsive and resilient government,” Remulla said.
Copies of the new IRR were not made available to journalists who covered the signing ceremony at DOJ.
