NBI agents cleared by OMB concerning arrest of 2 suspects in case of missing 'sabungeros'
The National Bureau of Investigation (NBI) said its agents have been cleared by the Office of the Ombudsman (OMB) over the 2021 arrest of two suspects believed involved in the disappearance of “sabungeros” or cockfight enthusiasts.
The bureau said in a statement that the OMB has issued a 22-page joint resolution dated Feb. 12 concerning the complaints filed against members of the NBI’s Task Force Against Illegal Drugs (NBI-TFAID), which is now called the the NBI Dangerous Drugs Division (NBI-DDD), concerning the arrest of siblings Nicasio Manio and Nicholes Manio.
“The Ombudsman found no merits in the charges filed against the Agents of NBI-TFAID led by Atty. Ross Jonathan V. Galicia, who acted within the scope of the law in the performance of their official duty as NBI Agents,” the NBI stated.
“Thus, the Ombudsman ordered the dismissal of all of the charges filed against the respondents,” it added.
The OMB issued the resolution after conducting the preliminary investigation of the complaint filed last year by the mother of the suspects, Joyce Manio.
The complaint accused Galicia and the NBI-TFAID of delay in the delivery of detained persons under the proper judicial authorities, violation of domicile, and grave coercion, all under the Revised Penal Code (RPC).
Galicia and the TFAID were also accused of having violated Republic Act (RA) 3019 or the Anti-Graft and Corrupt Practices Act; RA 7438 or the act defining certain rights of person arrested, detained or under custodial investigation as well as the duties of the arresting, detaining and investigating officers; RA 9165 or the Comprehensive Dangerous Drugs Act of 2002; RA 9745 or the Anti-Torture Act of 2009; and RA 8353 or the Anti-Rape Law.
The NBI noted that NBI-TFAID arrested the siblings during an anti-illegal drugs buy-bust operation at their house in Batangas on June 8, 2021 and were charged for violating RA 9165 and RA 10591 or the Comprehensive FireArms and Ammunition Regulation Act.
“The Subjects were brought before the Department of Justice (DOJ) for inquest proceedings within the 36-hour reglementary period,” the NBI said.
The Manio siblings have also been accused of being involved in the abduction of missing online cockfight workers Johnver Francisco and Fran Tabaranza in Maycauayan, Bulacan.
Philippine National Police (PNP) records show that there have been a total of 34 sabungeros who went missing since 2021.
