Public bidding required in sale of land where National Center for Mental Health is located in Mandaluyong City -- DOJ

The Department of Health (DOH) must participate in public bidding should it seek to secure the 47-hectare property or portions of the land where the National Center for Mental Health (NCMH) is located in Welfareville in Mandaluyong City, the Department of Justice (DOJ) said.

In a legal opinion dated last Aug. 2 addressed to DOH Secretary  Teodoro J. Herbosa, DOJ Secretary Jesus Crispin C. Remulla said that: “Section 1 of Republic Act No, 5260 categorically and explicitly stated that the sale of the Welfareville property shall be through public bidding.”

Remulla noted RA 5260, which was signed on June 15, 1968, “created and authorized a Trustee Committee to supervise the sale of the Welfareville property through public bidding in order to generate funds for programs and projects for the Welfare of the Filipino children.”

Section 1 of RA 5260 states: “In order to fullfill the agreement between the Philippine Government and various agencies of the United Nations, including UNICEF and the World Health Organizations, to disperse and decentralize its Welfareville Institutions, and to undertake other steps to upgrade child welfare services, there is hereby created a Trustee Committee for the purpose of which is to supervise the sale of Welfareville properties in the Municipality of Mandaluyong Province of Rizal, through public bidding.”

The Trustee Committee is composed of the Department of Social Welfare and Development (DSWD), the Department of Environment and Natural Resources (DENR), and the Commission on Audit (COA), Remulla said.

The DOH sought the legal opinion, Remulla explained, to determine “whether portions of the Welfareville property can be sold to the government offices/facilities occupying the same.”

“RA No. 5260 does not bear any qualification or requirement for the disposition of the Welfareville property,” since the law “prescribes only the mode of disposition, which is, sale through public bidding,” he said.

“In the absence, therefore, of any qualification or requirement in the said law, no other mode of disposition is legally permissible even if the buyers or beneficiaries will be the government agencies presently located in the Welfareville property, as the law did not make any distinction,” he pointed out.
