SC petition vs Maharlika Investment Fund expected -- SolGen Guevarra
Solicitor General Menardo I. Guevarra on Monday, Sept. 18, said he was not surprised at the petition filed against the alleged unconstitutionality of the Maharlika Investment Fund of 2023.
“The filing of such a petition is expected in view of the public interest generated by the creation of the Maharlika Fund,” Guevarra said.
“The OSG has been keenly following the public debates about the fund to determine what legal issues of transcendental importance, if any, may be raised before the Supreme Court,” he added.
On Monday morning, Sept. 18, the SC was asked to declare unconstitutional the Maharlika Investment Fund of 2023 under Republic Act No. 11954.
The petition was filed by Sen. Aquilino “Koko” Pimentel III, former congressman and Bayan Muna Chairman Neri Javier Colmenares, and former Bayan Muna congressmen Carlos Isagani Zarate and Ferdinand Gaite.
RA 11954 was signed into law by President Marcos last July 18 to be managed by the Maharlika Investment Corporation (MIC) which now has a seed capital of P150 billion.
