Dismissed disqualification cases vs Bongbong can still be appealed before SC — Comelec

The disqualification and cancellation of the certificate of candidacy (COC) petitions against presidential candidate Ferdinand “Bongbong” Marcos Jr. that have been dismissed by the Commission on Elections (Comelec) with finality can still be appealed before the Supreme Court (SC), an official of the poll body assured on Tuesday, May 10.

Comelec Director Genesis Gatdula, clerk of court of the poll body, made this assurance after the commission promulgated on Tuesday two resolutions that dismissed with finality disqualification cases against presidential candidate Ferdinand “Bongbong” Marcos Jr.

“The parties or the petitioners for these matters, because these cases were already dismissed by the Commission en banc, may file a petition for certiorari before the Supreme Court within 30 days from today, that is, upon the receipt of the decision pursuant to Sec. 64 of the Rules of Court,” Gatdula said during a press briefing.

“If there is no TRO (temporary restraining order) or orders for these resolutions, then these cases shall be deemed final and executory on the Commission on Elections level,” he added.

Among the disqualification petitions filed against Marcos, Gatdula said there is only one case remaining.

“There is still a pending MR (motion for reconsideration) filed by the petitioners in SPA 2021-235, that is the case of Salandangan et. al vs. Ferdinand ‘Bongbong’ Marcos Jr. and this was filed on April 25 and the same has been elevated to the Commission en banc on April 30th,” he said.
