Unconvinced with BSKE postponement? Comelec says SC is your last resort

Commission on Elections (Comelec) Chairman George Erwin Garcia said on Thursday, Oct. 13 that if the public sees something wrong with the postponement of the Barangay and Sangguniang Kabataan Elections (BSKE), they can always take it up with the Supreme Court (SC).

"You can always go to the SC, question the postponement," Garcia said during a press conference.
He made the statement in response to a question about the reaction of the public regarding the postponement, stating that unreliable village officials will remain in power for another year.
Garcia said that the poll body sympathizes with these sentiments and that they are legitimate concerns that should not be set aside. He added that if the decision were up to them, it would be part of their consideration.
"But of course, we can only implement the laws as promulgated by our political departments of government," he stated.
In the meantime, he mentioned that the law would have to be effective and Comelec will implement the law, and therefore the supposed Dec. 5, 2022 elections will be set aside.
"Ganun pagtingin natin na siguro nga nakakapanghinayang din (That's how we look at it and perhaps it's a bit regrettable). But a decision was already made and we have to respect the decision. But then, such a decision in the form of law can still be questioned in the SC," he explained.
On Wednesday, Oct. 12, President Ferdinand "Bongbong" Marcos, Jr. signed into law Republic Act 11935, entitled "An Act Postponing the December 2022 Barangay and Sangguniang Kabataan Elections, Amending For The Purpose Republic Act No. 9164, As Amended, Appropriating Funds Therefor, And For Other Purposes."
With this law, Garcia said that the legislative and the executive departments have seen fit to postpone the BSKE to October of 2023.
