DOJ issues lookout bulletin vs owner of vehicle involved in Mandaluyong City hit-and-run

The Department of Justice (DOJ) issued at noon today, June 14, an Immigration Lookout Bulletin Order (ILBO) against Jose Antonio San Vicente Sr., the registered owner of the vehicle that rammed a security guard last June 5 in Mandaluyong City.

Justice Secretary Menardo I. Guevarra said the ILBO was issued based on the criminal complaint filed against San Vicenter Sr. and the driver (still unidentified) of the vehicle for frustrated murder and violation of Article 275 of the Revised Penal Code (RPC) on abandonment of persons in danger and abandonment of one's own victim.

An ILBO mandates immigration officers stationed in all airports and seaports to report to the Bureau of Immigration (BI) and to the Department of Justice (DOJ) and its Office of the Prosecutor General (OPG) any attempt of San Vicente Sr. leave the country.

Once the prosecutors have filed before the regional trial court (RTC) of a criminal complains against San Vicenter Sr. and the court found probable case, the issuance of a precautionary hold departure order or hold departure order may be pleaded since only courts can issue either of the two orders.

Prosecutor General Benedicto A. Malcontento had said that the issuance of an ILBO was requested by the Mandaluyong City’s Office of the City Prosecutor (OCP).

Malcontento said the ILBO request was made after the Philippine National Police (PNP) filed before the OCP last June 6 criminal complaints against San Vicente Sr. who owns the vehicle.

Meanwhile, Malcontento said the OCP is set to conduct the preliminary investigation of the complaints against San Vicente.

PNP Spokesperson Col. Jean Fajardo earlier said: “The Mandaluyong City police filed a case of frustrated murder and a case in relation to violation of the Revised Penal Code for abandoning the victim.”

Last June 5, security guard Christian Joseph Floralde was rammed by a white Toyota RAV4, registered in the name of San Vicente Sr., while manning the traffic flow near a mall in Mandaluyong City.

The driver of the vehicle abandoned the security guard. The incident was caught on video which became viral online.

There have been reports that identified San Vicente Sr.’s son, Jose Antonio Jr., as the person who was driving the vehicle at the time the incident happened. The reports have not been confirmed.
