Quiboloy may be brought to US on 'temporary surrender' – DOJ

Kingdom of Jesus Christ (KOJC) founder and Pastor Apollo C. Quiboloy may still be brought to the United States, if his extradition is requested, even if there is a criminal case against him pending review by the Philippines’ Department of Justice (DOJ).

DOJ Chief State Counsel George O. Ortha II on Tuesay, Feb. 8, said a “temporary surrender” of a person to the Requesting State can be done by the Requested State under Article II of the Philippines-US Extradition Treaty.

“If the subject of the extradition is being prosecuted or is serving a sentence dito sa atin, pwede po ang temporary surrender (if the subject of the extradition is being prosecuted or is serving a sentence here in the Philippines, temporary surrender to the US is allowed),” Ortha explained.

He cited Article 11 of the treaty which provides: “If the extradition request is granted in the case of a person who is being prosecuted or is serving a sentence in the territory of the Requested State, the Requested State may temporarily surrender the person sought by the Requesting State for the purpose of prosecution. The person so surrendered shall be kept in custody in the Requesting State and shall be returned to the Requested State after the conclusion of the proceedings against that person, in accordance with conditions to be determined by agreement between the Contracting Parties.”

“Nagawa na po ito before. Nakapag ‘pahiram’ na po tayo dati ng isang tao na noo’y nakapiit (This has happened before. We have allowed them to ‘borrow’ a person who was already serving a sentence),” he said.

Quiboloy and two other members of the religious group were indicted last Nov. 10, 2021 before the US District Court for the Central District of California in Santa Ana, California for “conspiracy to engage in sex trafficking by force, fraud and coercion and sex trafficking of children; sex trafficking by force, fraud and coercion; conspiracy; and bulk cash smuggling.”

Due to the indictment, the US Federal Bureau of Investigation (FBI) has released “wanted” posters of Quibuloy.

In the Philippines, the complaint of alleged rape and child abuse against Quiboloy in 2020 had been dismissed by the Davao City prosecutor’s office.

But the complainant elevated to the DOJ the prosecutor’s resolution of dismissal. The appeal is still pending.

“Kung ma-dismiss pa rin yun appeal, at kung wala na syang kinakaharap na kaso dito sa atin, hindi na po applicable ang temporary surrender kasi posible na po ang extradition (Should the appeal be dismissed by the DOJ and he is facing no other cases in the Philippines, temporary surrender is no longer applicable and he can be extradited),” Ortha said.

He said the Philippine government has not received a request from the US government for Quiboloy’s extradition.
