Gov't prosecutors should file Dengvaxia cases before SC-designated QC RTC to avoid delays

Government prosecutors “should not contribute to the delay in the resolution of cases involving deaths and sufferings of victims from the anti-dengue vaccine Dengvaxia,” Public Attorney’s Office (PAO) Chief Persida V. Rueda Acosta said on Wednesday, Dec. 15.

Acosta said that some Department of Justice (DOJ) prosecutors have been filing Dengvaxia cases before other trial courts instead of lodging them before the Quezon City regional trial court (RTC) as directed by the Supreme Court (SC).

“Meron na pong utos ang Supreme Court na may isang Dengvaxia RTC family court (The SC has already ordered the designation of one family court to handle the Dengvaxia cases),” she said.

She pointed out that on Aug. 26, 2020, the SC granted PAO’s petition to have only one court to handle Dengvaxia cases and that is the Quezon City RTC Branch 107, a family court.

Thus, she stressed, the Quezon City RTC Branch 107 had started consolidating all Dengavaxia cases.

Citing records, Acosta said that there are already 157 criminal cases filed “involving 155 dead persons and two survivors who got inoculated with Dengvaxia.”

She also said that PAO had filed 66 civil cases and intends to file 16 more cases on Thursday, Dec. 16.

“Ang biktima dapat nagkakahustisya. Hindi yung papahirapan mo pa ang biktima (Victims should get justice. You don’t make them suffer),” Acosta said.

She noted that Quezon City RTC Branch 107 had to postpone its schedule last Dec. 6 for the pre-marking of evidence, arraignment and pre-trial conference.

She said the RTC was awaiting for the transmittal of three Dengvaxia cases filed by the DOJ before the metropolitan trial court (MeTC) Branch 83 of Caloocan City and MeTC Branch 114 in Muntinlupa City.
