DOLE bares pay rules for April 9, 10 holidays


Private sector employees who will render work on the observance of the Day of Valor on Tuesday, April 9 and Eidl' Fitr on April 10 are entitled to an additional wage as all the dates were declared a regular holiday, the Department of Labor and Employment (DOLE) said.

In a released statement on Friday, April 5, DOLE's National Wages and Productivity Commission (NWPC) clarified that employees must either report to work or take paid leave to receive full holiday pay.

“Upang ang empleyado ay makatanggap ng 100% ng kaniyang arawang sahod (basic wage x 100%) sa araw na ito, siya ay dapat pumasok o naka-paid leave sa huling araw ng trabaho bago ang nakatakdang regular holiday (To receive 100% of their daily wage (basic wage x 100%) on this day, the employee must either report to work or be on paid leave on the last working day before the scheduled regular holiday)," NWPC's statement read.

The NWPC issued a statement after the declaration of Eid'l Fitr as an official holiday on April 10. April 9, on the other hand, is a regular holiday as it was declared as Araw ng Kagitingan, or Day of Valor.

Employees who report to duty during the declared regular holiday should be paid a total of 200 percent of their wages for that day for the first eight hours, DOLE said. 

For employees’ overtime work, the department said they should be paid an additional 30 percent of their hourly rate on the said day, on top of the 200 percent.

On the other hand, employees who worked on a regular holiday that also falls on a rest day should be paid an additional 30 percent on top of the 200 percent wage. An additional 30 percent of the hourly rate shall also be paid when working overtime.

Meanwhile, employees who will not work should still be paid 100 percent of their wage for that day, subject to specific restrictions outlined in the Labor Code's implementing rules and regulations, as amended.
