The Department of Labor and Employment (DOLE) issued this reminder to employers Thursday, a day before the nation marks the 122nd anniversary of Philippine Independence.
"For work done during the regular holiday, the employees shall be paid 200 percent of their regular salary for the first eight hours," DOLE said in Labor Advisory No. 22, series of 2020.
For overtime work (work done in excess of eight hours), the Labor department said they shall be paid an additional 30% of their hourly rate.
The following pay rules are also applicable for a regular holiday:
If the employee did not work, the person shall be paid 100 percent of their salary for days indicated.
If an employee works on a regular holiday that also falls on their rest day, the person shall be paid an additional 30% of their hourly rate of 200%.
For overtime work on a regular holiday that also falls on the employee's rest day, they shall be paid an additional 30% of their hourly rate on the said day.
The same advisory, however, allowed some companies to defer the payment of the holiday pay until such time that the national health emergency is abated and normal business operations are resumed.
The Labor Advisory also said that those establishments that have totally closed or ceased operations during the community quarantine period are exempted from the payment of the holiday pay.
