Taguig voter asks Comelec to cancel CoC of Cayetano couple

By Leslie Ann Aquino A Taguig City resident has filed two separate petitions against former Senator Alan Peter Cayetano and his wife Maria Laarni "Lani" Cayetano, congressional aspirants in the May 2019 midterm polls. "They do not possess the minimum residency qualification imposed by the 1987 Constitution for the Members of the House of Representatives,” Atty. Emil Marañon III, Buac's counsel, said in a statement. Former DFA Secretary Alan Peter Cayetano is running for Congressman of the First Legislative District of Taguig-Pateros, while incumbent Taguig City Mayor Lani Cayetano is also running for Congress but in the Second Legislative District of Taguig City. Maranon cited the COC of Alan Peter Cayetano wherein he claimed that he is a resident of Barangay Bagumbayan in the First District, while Lani Cayetano claimed that she resides in Barangay Fort Bonifacio in the Second District. According to Buac's counsel, Article 69 of the Family Code mandates the Cayetano couple to fix one matrimonial domicile or residence while Article 68 obliges them to live there together. "Following this rule, the spouses cannot keep separate domiciles or for one spouse to claim a separate and independent domicile from the matrimonial domicile," said Marañon. Thus, he said Alan cannot claim domicile in Barangay Bagumbayan, while his wife, Lani Cayetano, in Barangay Fort Bonifacio. "In other words, they cannot run in two different districts or jurisdictions at the same time," Marañon said. The petition alleges that this scheme of the Cayetano couple is a "political ploy" to enable them to run in both the legislative districts of Taguig, and even encroach in the neighboring Pateros.
