The Department of Labor and Employment (DOLE) reminded employers to strictly follow the pay rules of their workers who will report for work during the Holy Week.
DOLE issued Labor Advisory No. 5, Series of 2019 that prescribed the proper payment of salaries on regular and special non-working holidays. Maundy Thursday (April 18), and Good Friday (April 19) are regular holidays, while Black Saturday (April 20) is a special non- working holiday.
The payment rules for the said regular holidays are as follows:
•If the employee worked, he/she shall be paid 200 percent of his/her salary for that day for the first eight hours of service.
•If the employee did not work, he/she shall be paid 100 percent of his/her salary for that day.
•If the employee worked in excess of eight hours (overtime work), the employee shall be paid an additional 30 percent of his/her hourly rate on said day.
•For work done during a regular holiday that also falls on the employee's rest day, he/she shall be paid an additional 30 percent of his/her doubled pay for the day.
•If the employee worked in excess of eight hours (overtime work) during a regular holiday that also falls on his/her rest day, the employee shall be paid an additional 30 percent of his/her hourly rate on said day.
The following payment rules shall be observed on the special non-working holiday (Black Saturday):
•If the employee did not work, the “no work, no pay” principle shall apply, unless there is a favorable company policy, practice, or collective bargaining agreement (CBA) granting payment on a special day.
•If the employee worked, he/she shall be paid an additional 30 percent of his/her basic salary on the first eight hours of work.
•For work done beyond eight hours (overtime work). the employee shall be paid an additional 30 percent of his/her hourly rate.
•If the special day falls on the employee's rest day, he/she shall be paid an additional 50 percent of his/her basic wage.
• If the employee worked in excess of eight hours (overtime work) during a special day that also falls on his/her rest day, the employee shall be paid an additional 30 percent of his/her hourly rate on said day.
