DOLE releases guidelines on work suspension due to bad weather

The Department of Labor and Employment (DOLE) has released the guideline for private sector employers and workers on suspension of work due to the southwest monsoon and typhoon "Carina".

In Labor Advisory No. 17-22, DOLE stated that private sector employers have the discretion to suspend work to prioritize the safety and health of employees during calamities.

The DOLE said employees who have reported to work are entitled to receive their full regular pay, provided that they have rendered work for a minimum of six hours.

However, those who have worked for less than six hours shall receive a proportionate amount of their regular pay, unless a more favorable company policy or practice exists for the employee.

On the other hand, employees who are unable to work are not entitled to regular pay, except when there is a company policy, practice, or collective bargaining agreement that grants wages for such days or if employees are allowed to use their leave credits.

The advisory added that employers have the option to offer additional incentives to employees who reported to work during these challenging weather conditions, aiming to alleviate their difficulties.

Furthermore, it was noted that employees who choose not to work due to imminent danger from weather disturbances and similar events cannot face any administrative sanctions.

The labor advisory was issued in accordance with Article 5 of the Labor Code of the Philippines, as amended, and Republic Act 11058.
