SC Spokesperson Brian Keith F. Hosaka on Friday, March 26, said that Justice Delos Santos cited “health reasons” for the early retirement.
“This is the reason why he advised his staff as early as 19 March 2021, through a letter of even date, to start looking for other employment knowing the difficulty of finding a job during this pandemic,” Hosaka said.
“Justice Delos Santos further added that he remains an incumbent member of the Supreme Court until after a specific date of retirement, as may be indicated in a formal letter from him to the En Banc, is accepted and acted upon by the Court,” he added.
If approved by the SC as a full court, Delos Santos would be the third SC justice who opted for early retirement.
In November last year, the SC approved the disability retirement of Associate Justice Priscilla J. Baltazar Padilla whose mandatory retirement would have been on July 2, 2028.
Last January, the SC also approved the early retirement on March 27, 2021 of Chief Justice Diosdado M. Peralta. His term would have ended on March 27, 2022.
Delos Santos became a municipal trial court judge in 1983, judge of the municipal trial court in cities in 1987, a regional trial court judge in 1993, an associate justice of the Court of Appeals in 2008, and finally as associate justice of the SC in 2019.
