The Dimple Star Transport company asked the Land Transportation Franchising and Regulatory Board to lift the suspension on their units saying that the bus involved in an accident in Occidental Mindoro killing 19 persons last March, was separately owned and operated by a different franchise holder.
The wreckage of the Dimple Star bus which figured in a road mishap that left 19 dead and 21 wounded at Sablayan, Occidental Mindoro last Tuesday lies just beside the Patrik bridge.
(ROBINSON NIÑAL JR./PRESIDENTIAL PHOTO / MANILA BULLETIN) Dimple Star Transport company legal counsel Cesar Cainglet said that the entire fleet of 118 units of Dimple Star have two different owners, several franchises are operated and owned by Hilbert Napat, while some are under the Dimple Star Transport Corporation. "Dalawa ang franchise niyan. One is si Hilbert Napat as a single proprietor, na owner ng naaksidenteng bus, at ang Dimple Star Transport Corporation, na sana hindi sinama sa nasuspend ang mga units, kasi dalawang magkaiba sila. They are two distinct legal personalities," said Cainglet in an interview after the hearing with the LTFRB. During the en banc session on Wednesday, the bus company also asked for a period of 20 days for them to submit their position paper on the main case of the franchise owned and operated by Napat. Cainglet also told the board members that they will withdraw their motion for reconsideration should the LTFRB issued an order regarding their compliance with the suspension. "Pina-inspeksyon namin lahat ng mga units. Yung mga drivers at konduktor pina-drug test namin, pina-attend ng seminar, para maipakita namin na maayos din ang aming mga empleyado. Na sana maaprubahan yung aming pagsunod sa PSO. At ang susunod sana doon, ma-lift ang suspension. Yun ang pakiusap namin sa LTFRB," Cainglet added. The bus line have stopped operating since the Board issued a preventive suspension order on their entire fleet pending resolution on the case. At least 70 units out of the whole 118 units, meanwhile, have complied with the PSO and already submitted for resolution. According to LTFRB member Atty. Aileen Lizada, upon receiving the bus line's position paper, the case will be submitted for resolution. On the previous hearing of the case last April, it was learned that the Dimple Star bus, which fell into a ravine in Sablayan, Occidental Mindoro after reportedly losing its brake, was built from scrap bought from a junkyard. President Rodrigo Duterte also directed transport officials to conduct a crackdown of all colorum vehicles following the accident, and ordered the cancellation of the Dimple bus franchise. A closure order was also issued to the bus company last March citing "gross negligence" for "pathetic conditions" of its terminal and buses, and previous accidents involving its units that killed and wounded many.#
