Mamamayang Liberal (ML) Party-list Rep. Leila de Lima has corrected Acting Davao City Mayor Sebastian "Baste" Duterte's assertion that his sister Vice President Sara Duterte's impeachment case is now "over".
Mayor Duterte said this in reaction to the Supreme Court (SC) recent ruling wherein it deemed the House-prepared impeachment complaint as unconstitutional due to a technicality.
Thus, the mayor said over the weekend the House of Congress should just "accept their defeat", and that the SC decision was "the end" or "conclusion" of the impeachment case.
"Hindi pa ho natin pwede tanggapin [na talo na] dahil meron pa ho tayong remedyo (We cannot accept defeat yet because we still have available remedies)," De Lima said in a chance interview Monday, Aug. 4.
"Umaasa pa po talaga kami na sa pag-file ng motion for reconsideration (MR) ng House of Representatives…..We are still hoping, praying na magkakaroon ng re-examination especially of the material and crucial facts na medyo mali yung pagkaka-intindi ng Korte Suprema," underscored De Lima, a lawyer.
(We are truly still hoping that with the filing of the motion for reconsideration by the House of Representatives... We are still hoping praying that there will be a re-examination, especially of the material and crucial facts that the SC seems to have misunderstood.)
In his podcast wherein he told the pro-impeachment congressmen to give up following the SC's decision, Mayor Duterte appeared unaware that the filing of an MR was even an option.
A group led by Akbayan Party-list Rep. Perci Cendaña, the endorser of the first impeachment complaint filed against Vice President Duterte, had filed an MR last Friday.
"So hindi po dapat kaagad…. tinatanggap hindi pa naman po talo ito, wala pa ho tayo dyan kasi nga meron pang remedyo (So this must...not be immediately accepted, this isn't a defeat, we're not there yet because there are still remedies)," De Lima said.
This means that the impeachment case isn't dead in the water as some may claim.
"We’re hoping hindi pa talaga (We're hoping that it isn't the case). It’s not yet dead in the water," said the former senator.
