ICC prosecutor submits 6th batch of evidence vs Duterte
The International Criminal Court (ICC) prosecution has submitted a sixth batch of evidence in its case against former president Rodrigo Duterte for crimes against humanity, covering alleged murders during his administration’s anti-drug campaign.
In a June 3 notice, ICC Deputy Prosecutor Mame Mandiaye Niang said the Office of the Prosecutor disclosed 90 items to the Defense on May 23. These items were categorized under three thematic packages and include alleged killings tied to the so-called “barangay clearance operations” during Duterte’s presidency.
According to the filing, the evidence includes:
- Pre-Confirmation INCRIM Package 009 (23 May 2025): Crimes Against Humanity – Murder, Barangay Clearance Operations during the Presidential Period (32 items listed in Confidential Annex A)
- Pre-Confirmation INCRIM Package 010 (23 May 2025): Crimes Against Humanity – Murder, Barangay Clearance Operations during the Presidential Period (35 items listed in Confidential Annex B)
- Pre-Confirmation Rule 77 Package 001 (23 May 2025): Contextual elements and background information relevant to the preparation of the defense (23 items listed in Confidential Annex C)
The annexes remain confidential, the document clarified, as they contain inter partes evidence disclosed between the parties and are not for public release.
The Prosecution must complete all evidence disclosure by July 1, ahead of the scheduled confirmation of charges hearing on Sept. 23, as directed by ICC Pre-Trial Chamber I.
The latest disclosure adds to what the ICC earlier said was at least 421 documents, nine photographs, and nearly 16 hours of audio and video materials intended for use in the proceedings against Duterte.
On Feb. 10, the ICC’s Office of the Prosecutor applied for an arrest warrant against Duterte for “crimes against humanity of murder, torture, and rape.”
On March 7, the ICC issued the warrant under seal, before making it public on March 11. Duterte was surrendered to The Hague on March 12, following his arrest by Philippine authorities.
Duterte’s initial appearance before the Pre-Trial Chamber took place on March 14 via video link.
