DOJ asked to provide update on case of slain Samar farmer

The Department of Justice (DOJ) was asked to provide an update on the case of farmer Enrique Manas who was killed in 2017 in Sta. Margarita town of Samar allegedly over local politics.
In a letter, Samar 1st District Rep. Stephen James T. Tan said the DOJ should provide an update on the case, particularly on the motion for reconsideration filed by the main accused in the case.
The letter was received by the DOJ on August 20 and Tan said it was done in response to a request for assistance from the Manas family, who are from the First District of Samar.
In the letter, the solon asked the DOJ to determine whether or not the motion for reconsideration filed by Emilio Zosa has already been submitted for resolution and whether or not there are any remaining procedural requirements or submissions.
The DOJ was asked whether counsel representing the victims and the Manas family had been furnished a copy of the motion for reconsideration and given an opportunity to submit their comment, opposition or position.
The letter said the third matter was particularly important to the victims’ family given the gravity of the offense and their direct interest in the proceedings.
The case had been pending through various stages of proceedings and review before the DOJ for several years, with nearly nine years having passed since the ambush.
In January 16 last year, the DOJ issued a resolution directing the filing of criminal charges after a review of the evidence and a determination that the case should proceed to court.
In April this year, the DOH said the case had already been received by the court but a motion for reconsideration was filed. The DOJ has yet to publicly announce its resolution on the Motion for Reconsideration.
