'Kilabutan ang may kagagawan': Solons blast Pasig court injuction vs P85 NCR wage hike

Minority congressmen are up in arms over a Pasig City regional trial court (RTC) ruling that is prolonging the implementation of the P85 wage hike for workers in the National Capital Region (NCR) or Metro Manila.
Thursday, Aug. 13 was the last day of the temporary restraining order (TRO) Pasig City RTC Branch 152 against the implementation of the NCR wage hike. However, the court also issued a preliminary injunction against the salary adjustment on tje same day.
"Ibig sabihin, hindi maipapatupad ang wage hike habang pending ang kaso sa korte. Nakakalungkot ang kautusang ito," Assistant Minority Leader Akbayan Party-list Rep. Chel Diokno said.
(This means the wage hike cannot be implemented while the case is pending in court.This order is disheartening.)
"Malinaw na nakasaad sa Article 126 ng Labor Code na bawal maglabas ang anumang hukuman ng TRO at maging preliminary o permanent injunction laban sa anumang wage order. Ang tamang proseso para sa pag-apela ng isang wage order ay nasa Article 123 ng Labor Code, at hindi ito inihahain sa [RTC]," he pointed out.
(Article 126 of the Labor Code clearly states that no court may issue a TRO or even a preliminary or permanent injunction against any wage order. The proper process for appealing a wage order is found in Article 123 of the Labor Code, and it is not filed in the RTC.)
Senior Deputy Minority Leader Mamamayang Liberal (ML) Party-list Rep. Leila de Lima echoed Diokno's frustration over the court's actions.
"Mahiya at kilabutan naman ang mga may kagagawan nito (Those responsible should feel shame and fear)," she said.
"It’s deeply frustrating and disappointing that the injustice and suffering endured by our workers are being further prolonged by a court decision that violates the Labor Code," noted De Lima.
"Di natin kailanman mauunawaan at matatanggap kung bakit pahirapan pang maibigay sa hirap na hirap na nating mga manggagawa ang kakarampot na nga lang na pagtaas sa kanilang kita. This is long overdue and far less than what they truly deserve to receive," she said.
(We can never understand nor accept why it is made so difficult to give our struggling workers even this meager increase in their income.)
Injunction bond 'message' slammed 
De Lima especially assailed the P10-billion injunction bond.
"What message is being conveyed by requiring a P10 billion injunction bond? Na mas gugustuhin pang mag-post ng bond ng mga petitioners-employers na may ganyang napakalaking halaga kesa ibigay sa mga manggagawa ang P85 na umento?
(Is it because the petitioners-employers would rather post a bond of such a huge amount than give workers the P85 increase?)
"Eh di ba ang idinadahilan nga sa pagharang sa umento ay hindi raw kakayanin ang hinihinging dagdag pasahod?" she asked.
(Isn’t their reason for blocking the increase that they supposedly cannot afford the additional wages?)
As a parting shot, Diokno said: "Sa taas ng presyo ng bilihin, hindi nga sapat ang P85 wage hike para sa pangangailangan ng mga manggagawa at kanilang mga pamilya. Nananawagan tayo sa mga kasamahan natin sa Kongreso: Ipasa at isabatas na ang P200 daily wage hike na isinusulong ng Akbayan Party-list sa lalong madaling panahon."
(With the high prices of goods, the P85 wage hike is not even enough for the needs of workers and their families. We call on our colleagues in Congress: Pass and enact the P200 daily wage hike being pushed by the Akbayan Party-list as soon as possible.)
