  • Private prosecutor Amando Virgil Ligutan refuses to delete his Facebook post asserting that misleading questions are not allowed during cross‑examination, citing the Rules of Court.
  • The post appears to counter defense lawyer Kristine Ferrer's claim in Vice President Sara Duterte's impeachment trial that misleading questions are permissible, though Ligutan does not name anyone directly.
  • Ligutan insists his statement carries no bad faith or malice, likening it to a simple truth such as "one plus one equals two," and defends his right to post legal principles publicly.

Don't expect private prosecutor Amando Virgil Ligutan to delete his Facebook post on the usage of misleading questions during a witness' cross-examination in the courtroom.
Ligutan's particular post on Wednesday, Aug. 12 read: "A principle ALL lawyers and law students know by heart: Misleading questions are NOT allowed even on cross- examination."
To an observer, the post appeared to be a reference to defense lawyer Kristine Ferrer's concurrent remarks in Vice President Sara Duterte's Senate impeachment trial, wherein she argued that misleading questions were allowed during cross.
Only, Ligutan didn't mention anybody.
It was apparent in a chance interview after the hearing that the Cebu lawyer felt strongly about the matter.
"Buburahin ko ba? Hindi po allowed ang misleading question. Hindi ko po yun buburahin kasi yun po yung nakasaad sa ating Rules of Court," he said.
(Will I delete it? Misleading questions are not allowed. I will not delete it because that is what is stated in our Rules of Court.)
"Buti sana kung I named somebody, buti sana if I said this is regarding this.
Even that, no? Pwede pang i-argue, wrong yan. Basahin niyo yung post," he noted.
(It would be different if I named somebody, it would be different if I said this is regarding this. Even then, right? You could still argue it’s wrong. Read the post.)
Ligutan reckoned that it's his right as a human being to "post anytime...something that I believe is written in the Rules of Court".
The prosecutor further said that there was "no bad faith, no malice" about his Facebook post.
"It's just like saying one plus one equals two. At that particular time, inside the impeachment case. No misleading question is allowed. It's as true as the sun rising from the east and setting at the west. One plus one equals two. There's nothing illegal about it," he further explained.
