BIR clarifies rules to help small businesses clear back taxes

The Bureau of Internal Revenue (BIR) has released guidelines clarifying the tax abatement initiative for micro-enterprises to clear up confusion surrounding eligibility criteria and unresolved penalties.
Under Revenue Memorandum Circular No. 84-2026, the tax authority outlined the operational mechanics for Revenue Regulations No. 4-2026, which governs the one-time abatement of taxes and penalties for micro taxpayers.
To qualify for the tax abatement, the BIR said that liabilities must stem from qualified tax cases existing on or before Dec. 31, 2025.
The bureau specified that business owners can confirm their micro-taxpayer status online through the BIR Online Registration and Update System, known as ORUS, or by consulting directly with their designated Revenue District Office.
The new directive adopts a structured question-and-answer format designed to navigate complex edge cases that previously delayed filings.
Specifically, the circular details how the bureau intends to handle pending compromise applications, one-time transaction taxes, open-case penalties, and taxpayers carrying uncollected liabilities across multiple taxable years.
It also addresses the treatment of partial payments and defines the exact conditions under which an application will be denied.
For small enterprises navigating the process, the issuance clarifies the step-by-step procedures for calculating and paying the required one-time abatement fee.
Once an application is approved and the fee is settled, the BIR said the revenue bureau will issue an official Certificate of Availment, which serves as conclusive proof that the covered liabilities and accrued penalties have been legally discharged.
The BIR said the circular was issued to address widespread compliance questions from small business owners seeking to settle outstanding liabilities without incurring punitive fines.
The tax agency, meanwhile, urged micro-taxpayers to review the circular promptly to determine whether their existing liabilities qualify before filing deadlines lapse.
The BIR program forms part of broader effort by domestic revenue authorities to expand the tax base, improve voluntary compliance, and clear a long-standing backlog of minor audit disputes involving small-scale entrepreneurs across the country.
