Solon tells LGUs: Step up, adhere to high NCAP standards

House Deputy Majority Leader 1-Rider Party-list Rep. Rodge Gutierrez is prodding local government units (LGUs) to adhere to higher No Contact Apprehension Program (NCAP) standards.
This, after the lawyer-legislator acknowledged the Supreme Court’s (SC) resolution dismissing the consolidated petitions challenging NCAP in Metro Manila.
While noting the high court's ruling, Gutierrez emphasized that the petitions were dismissed primarily on the ground of mootness following the adoption of the Metro Manila Traffic Code of 2023 (MMTC 2023) and related implementing measures, rather than on the substantive constitutional issues raised by the petitioners.
“Nirerespeto po natin ang procedural na dahilan kung bakit na-dismiss ang mga petition, pero gusto ko pong linawin na ang mga pangunahing concerns tungkol sa due process, privacy, at karapatan ng mga motorista ay hindi pa rin nalutas sa substance ng kaso,” said the senior vice chairperson of the House Committee on Transportation.
(We respect the procedural reason why the petitions were dismissed, but I want to clarify that the main concerns about due process, privacy, and motorists’ rights remain unresolved in the substance of the case.)
Gutierrez pointed out that while the current system may not yet be perfect, the Metropolitan Manila Development Authority (MMDA) has been very responsive to suggestions and criticism.
The agency, he noted, has made significant reforms to address many of the issues that prompted the original legal challenge.
“1-Rider Party-list recognizes that the MMDA has made substantial improvements in updating the system. The new uniform framework under MMTC 2023 incorporates better safeguards, clearer procedures, data privacy measures, and fairer adjudication processes,” Gutierrez said.
The the ranking congressman called on all LGUs implementing NCAP to match or exceed the standards set under the new Metro Manila framework.
“We urge all LGUs to step up and adhere to the same high standards of fairness, transparency, and accountability in traffic enforcement programs. Motorists deserve consistent, equitable, and corruption-free enforcement across the entire region.”
He assured the public that 1-Rider Party-list will continue to monitor the implementation of NCAP closely.
“Patuloy na babantayan ng 1-Rider Party-list ang NCAP. Sinusuportahan namin ang mga hakbang para maibsan ang trapik at magkaroon ng disiplina sa kalsada. Ngunit nananatiling priyoridad namin ang proteksyon sa karapatan ng mga motorista at ordinaryong mamamayan,” Gutierrez said.
(1-Rider Party-list will continue to monitor NCAP. We support measures to ease traffic and instill discipline on the roads. But our priority remains the protection of motorists’ rights and ordinary citizens.)
