CEBU CITY – Controversial contractor Sara Discaya was allowed to post bail of P1 million in connection with the malversation charges she is facing over an alleged P96.5-million ghost flood control project in Davao Occidental.
Presiding Judge Nelson Leyco of the Regional Trial Court Branch 27 in Lapu-Lapu City also granted P300,000 bail to Czar Ryan Ubungen, chief of the finance section of the Department of Public Works and Highways (DPWH) engineering district in Davao Occidental.
Despite the approval of the bail, Discaya will still not be released from the Lapu-Lapu City Jail as she and her husband Pacifico “Curlee” Dsicaya are facing a separate non-bailable case over an alleged anomalous project in Bulacan.
In granting the bail, Leyco, in his resolution dated July 7, stated the pieces of evidence highlighted by the prosecution "are not yet enough to prove Discaya's instrumental participation in committing the criminal act of falsifying the documents or in conspiring with the other accused."
While Discaya and Ubungen’s petitions to post bail were granted, similar requests by several DPWH officials accused in the case were denied.
The petition for bail by Maria Roma Angeline Rimando, managing officer of a Discaya-owned company, was also denied.
Discaya and the other respondents were accused of conspiring to release P96.5 million to construct a revetment project in Jose Abad Santos in Davao Occidental. The project was allegedly never implemented.
Discaya was arrested in December last year and was subsequently detained at the Lapu-Lapu City Jail.
