Marcoleta to be committed to QC jail where Revilla, Estrada are detained—Sandiganbayan

Senator Rodante Marcoleta will be committed to the New Quezon City Jail in Payatas, where former senator Ramon “Bong” Revilla Jr. and Senator Jinggoy Estrada are currently detained, after the Sandiganbayan Third Division ordered his arrest over a plunder case lodged against him.
According to Third Division Chairperson Associate Justice Karl Miranda, Marcoleta will be committed to the New Quezon City Jail in Payatas, along with his co-accused—former lawmaker Michael “Mike” Defensor and businessmen Joseph Varias Espiritu and Aristotle Baluyot Viray.

Miranda reiterated that the issuance of the warrants merely means the court found probable cause based on its evaluation of the records and should not be construed as a finding of guilt.
He added that probable cause exists when the facts and circumstances “would lead a reasonably discreet and prudent person to believe that an offense has been committed by the persons to be arrested.”
On July 3, the Office of the Ombudsman (OMB) filed before the anti-graft court a plunder case, a non-bailable offense, against Marcoleta over the alleged P75 million in undeclared donations he received while he was still serving as a congressman, along with three separate criminal cases for violation of Presidential Decree (PD) No. 46, or the anti-gift law, against the senator and his alleged donors.
The OMB stressed that the senator himself had publicly acknowledged receiving the money, saying the fact of receipt is not disputed and may even be stipulated at the start of the trial.
On June 1, the Sandiganbayan’s Fifth Division ordered the arrest of Estrada and his co-accused in the plunder case stemming from alleged illegal budget insertions and purported kickbacks linked to Department of Public Works and Highways (DPWH) projects.
Estrada and former DPWH Secretary Manuel Bonoan are facing two counts of graft, with one case raffled to the Sandiganbayan’s Second Division and another graft case assigned to the Fifth Division.
The plunder case against all the respondents was likewise raffled to the Sandiganbayan’s Fifth Division.
The New Quezon City Jail also houses Revilla, who is facing graft and malversation charges before the Sandiganbayan.
Revilla and his co-accused were charged in connection with the alleged anomalous implementation of a P92.8-million flood-control project in Pandi, Bulacan.
