The Criminal Investigation and Detection Group (CIDG) has included cases of homicide and reckless imprudence resulting in homicide in the recommendation it made against former Ateneo de Manila head coach Tab Baldwin and other members of the coaching and conditioning staff.
CIDG director Maj. Gen. Robert Alexander Morico said this is aside from the case of violation of the Republic Act No. 11053 (Anti-Hazing Act of 2018), adding that the cases recommended are two counts to cover the death of student-athletes Rene Baterbonia and Divine Adili.
He said the cases were already referred to the Department of Justice (DOJ) for case build-up and evaluation.
Baterbonia and Adili drowned during an off-campus training in a beach resort in Aurora on June 8. Several agencies that include the CIDG conducted an investigation to shed light into the incident.
Last week, the CIDG announced that it recommended the filing of violations of Anti-Hazing Law against Baldwin and 11 other members of the coaching and conditioning staff of the basketball team.
Also included were two utility personnel and their inclusion is based on the provision of the law that their mere presence is enough for them to be held accountable.
Department of the Interior and Local Government (DILG) Secretary Jonvic Remulla clarified that they will leave to the DOJ the decision on whether or not the utility boys will be included in the charge sheet.
The Ateneo de Manila University earlier vowed to provide all the necessary legal assistance to the two ball boys. Some legal luminaries also called out the CIDG for the inclusion of the two utility boys.
As to other personalities included in the case referral for homicide and reckless imprudence resulting in homicide, the CIDG said the investigation is still ongoing to specifically identify each of them.
The additional cases referred to the DOJ were homicide under Article 249 and Reckless Imprudence resulting in Homicide under Article 365 of the Revised Penal Code.
All the details of the investigation were fully explained to the family of Baterbonia during a meeting at the CIDG headquarters at Camp Crame in Quezon.
Morico personally met Baterbonia’s parents Rene Sr. and Rovelyn, and their eldest son Ruveyan. They were accompanied by their two female legal counsels.
““The purpose of the meeting are two things: one, to inform them of the result of our investigation because they have the right to know,” said Morico.
“Second is to assure them that in all stages ng prosecution, if this one goes to trial, the CIDG will be there to continuously follow-up this case,” he added.
For their part, the Baterbonia family expressed their gratitude to the PNP and CIDG for the investigation.
