CEBU CITY – The brother of former Cebu Gov. Gwendolyn Garcia was arrested for alleged violation of a law that penalizes gender-based sexual harassment.
Byron Garcia was arrested on Thursday afternoon, June 11, for three counts of alleged violation of Republic Act No. 11313, widely known as the Safe Spaces Act or the Bawal Bastos Law.
Byron was arrested by operatives of the Cebu Police Provincial Office and Talisay City Police Station at the Talisay Fish Port in Barangay San Roque, Talisay City.
Judge Jennifer Pepito-Nimaniwa of the Municipal Trial Court in Cities (MTCC) Branch 1 in Mandaue City issued the arrest warrant against Byron. Bail was recommended at P108,000.
The charges were filed by Dr. Elisse Nicole Catalan, the daughter of incumbent Cebu Gov. Pamela Baricuatro.
Byron has become a staunch critic of the mother and daughter following last year’s election that saw Baricuatro score a massive upset win against the then governor Gwendolyn.
In several Facebook videos, Byron criticized Catalan and Baricuatro over several issues.
When sought for comment over his arrest, Byron said he has no knowledge over the nature of the case but confirmed that based on the arrest warrant, the charges against him were filed by Catalan.
On Friday, June 12, Catalan took to Facebook to address the issue.
“As a private citizen who has been subjected to conduct I believe violated my rights and dignity, I chose to stand up and seek accountability through the proper legal process,” she said.
“This case is not only about me. It is about affirming that no one is above the law, and that every person deserves to be treated with respect, whether in public spaces, workplaces, educational institutions, or online platforms,” Catalan added.
Catalan emphasized that the Safe Spaces Act “exists to protect individuals from gender-based sexual harassment and other unlawful conduct. It applies equally in our streets, workplaces, schools, and digital spaces.”
“Today, on Independence Day, I am reminded that true freedom includes the freedom to live and participate in society without fear of harassment, humiliation, or intimidation,” said Catalan.
