The Sandiganbayan’s Fifth Division on Thursday, June 4, reset to June 30 the arraignment of Senator Jose “Jinggoy” Ejercito Estrada and former Department of Public Works and Highways (DPWH) Secretary Manuel Bonoan on plunder and graft charges to allow the court sufficient time to resolve their respective motions to quash the cases.
During the hearing, the anti-graft court noted that both accused had challenged the validity of the informations filed against them, prompting the postponement of their arraignment.
With the deferment, Estrada’s camp withdrew its pending motion to fix bail as well as its motion seeking the senator’s transfer to Camp Crame.
Estrada’s counsel told the court that the defense intends to first secure a ruling on its motion to quash the informations filed by the Office of the Ombudsman (OMB) before proceeding further.
For his part, Bonoan’s counsel informed the court that a motion to quash had been filed earlier in the day.
The Sandiganbayan directed the prosecution to submit its comment on the motions to quash within 10 days from Thursday.
Estrada is currently committed to the New Quezon City Jail in Payatas, where former senator Ramon “Bong” Revilla Jr. is currently detained.
It can be recalled that on June 1, Estrada asked the Sandiganbayan to dismiss the plunder and graft charges filed against him by the Office of the Ombudsman in connection with alleged illegal budget insertions and purported kickbacks linked to DPWH infrastructure projects.
In an Urgent Omnibus Motion Ad Cautelam, Estrada’s legal team urged the anti-graft court to quash the informations and dismiss the cases.
“Today, my legal team filed a third pleading – an Urgent Omnibus Motion Ad Cautelam – praying that the information be quashed; the case be dismissed with prejudice, or, in the alternative, that the proceedings be suspended and the case remanded for reinvestigation and/or the completion of the preliminary investigation,” he said in a statement sent to reporters covering the Sandiganbayan.
In the afternoon of the same day, the Fifth Division of Sandiganbayan issued an arrest warrant against Estrada and his co-accused.
On May 28, the Office of the Ombudsman (OMB) filed plunder and graft charges before the Sandiganbayan in connection with alleged illegal budget insertions and the disbursement of more than P573 million in purported kickbacks involving DPWH infrastructure and flood-control projects funded under the Fiscal Year 2025 budget.
