Senate won't receive subpoena for CCTV footage of gunfire — Ombudsman

The Senate refused to receive a subpoena seeking a copy of closed-circuit television (CCTV) footage of the Senate shooting incident, Ombudsman Jesus Crispin “Boying” Remulla said on Saturday, May 16.
According to Remulla, their process server encountered difficulty serving the subpoena at the Senate despite Senate personnel already having notice of it.
“Nagkakaproblema. ‘Yung aming process server ayaw na naman tanggapin sa Senate (We encountered a problem. Our process server’s documents are again not being accepted at the Senate),” Remulla said in a radio interview.
“Pero may notice na eh. Sinabi nga ni Alan Cayetano, dapat icharge din si Matibag, ibig sabihin alam na nila na mayroon talaga silang suspension na (But they already have notice. Senator Allan Cayetano even said [NBI Director Melvin] Matibag should also be charged, which means they already know there is indeed a suspension order),” he went on.
Remulla said he could not understand why Senate personnel allegedly refused to receive the subpoena, adding that he already considered it served since they were already aware of the notice.
“Pero ayaw nilang tanggapin. Di ko sila naintindihan. Kasi sa akin considered served na yan. Kahit hindi nila tinanggap kasi may notice na sila (But they still refuse to receive it. I don’t understand them. For me, that is already considered served. Even if they did not accept it because they already have notice),” he said.
The Ombudsman criticized the alleged refusal, saying nobody is above the law.
On Friday, May 15, Remulla placed Senate Sergeant-at-Arms Mao Aplasca under preventive suspension without pay for six months effective immediately as the OMB began its investigation into the shooting incident inside the Senate.
He said the suspension was meant to prevent any possible influence on the ongoing probe.
The Ombudsman also disclosed earlier that subpoenas had already been issued for the Senate’s CCTV footage from the night of the incident amid allegations that some footage may have been concealed.
Remulla said the OMB had already issued a subpoena directing the Senate to provide CCTV footage from the night of the incident so investigators could review the entire sequence of events.
He also expressed hope that no footage was missing, noting that allegations had surfaced claiming some CCTV recordings may have been hidden and that there could have been an attempt to cover up the incident.
Remulla also said the OMB would subpoena footage from media organizations and other individuals present during the incident.
