SC junks petition vs constitutionality of Independent Commission for Infrastructure
The Supreme Court (SC) on Wednesday, Feb. 4, dismissed the petition which challenged the constitutionality of the creation of the Independent Commission for Infrastructure (ICI) to probe irregularities in the flood control projects of the government.
Executive Order No. 94 that created the ICI was issued by President Marcos last Sept. 11, 2025 to probe the government’s flood control and other infrastructure projects for the past 10 years from the date of effectivity of the EO.
During its Feb. 4 full court session, the SC ruled that the petition violated the hierarchy of courts doctrine because it was filed directly with the High Court.
In a resolution written by Associate Justice Samuel H. Gaerlan, the SC said that while direct recourse to the SC is allowed in exceptional cases, the petition failed to cite any compelling reason to bypass the lower courts.
The press briefer issued by its Office of the Spokesperson stated that the SC pointed out that the petitioners did not show that an actual case or controversy exists, which requires a violation of a legally enforceable right.
It added that the petition did not show that the rights of the petitioners were violated, or that EO 94 which created the ICI adversely affected them.
Dismissed by the SC was the petition filed by Jacinto V. Paras, Manuelito Delos Reyes Luna, and Ferdinand S. Topacio.
