DOJ sets resolution on 5 "ghost" flood control cases in Bulacan
The Department of Justice (DOJ) is expected to release until Friday, Jan. 23, its resolution on the five cases in the “ghost” flood control projects contracted by Syms Construction Trading in Bulacan.
DOJ sources said the resolution will approve the filing of criminal cases before the Regional Trial Court (RTC) against the respondents.
DOJ Spokesperson Niccolo L. Martinez said the resolution is currently being finalized by a panel of prosecutors which handled the preliminary investigation.
The “ghost” projects were identified as those in Balagtas and Pandi towns in Bulacan.
The charges filed in the five cases were malversation of public funds through falsification of public documents under Article 217 in relation to Article 171 Paragraph 4 of the Revised Penal Code (RPC); perjury under Article 183 of the RPC; and violations of Section 3(e) of Republic Act No. 3019, the Anti-Graft and Corrupt Practices Act.
Among the respondents in the cases were former Department of Public Works and Highways (DPWH) Bulacan First District Engineer Henry C. Alcantara; former DPWH Bulacan First District Engineers Brice Ericson D. Hernandez and Jaypee D. Mendoza; and Syms Construction representative Sally N. Santos.
Also, respondents in one of the cases were former senator Ramon “Bong” Revilla Jr. and resigned congressman Zaldy Co.
Both Revilla and Co have been charged before the Sandiganbayan on different cases. Arrest warrants have been issued against them.
Published reports stated that Revilla has surrendered to the Philippine National Police (PNP), while Co – who is abroad – has been declared a fugitive from justice.
Meanwhile, Martinez said the DOJ will be filing before the Senate a formal request to have Alcantara transferred to the custody of the Witness Protection Program (WPP).
Earlier, Acting Justice Secretary Fredderick A. Vida said the government has four state witnesses in the flood control cases and they committed to return about P1.5 billion.
Aside from Alcantara and Santos, the two other state witnesses are former DPWH undersecretary Roberto R. Bernardo and DPWH Regional Director Gerard P. Opulencia.
The DOJ said that a total of P316 million have been returned to the government. It said that Alcantara turned over P181 million; Opulencia, P80 million; Bernardo, P35 million; and Santos, P20 million.
