First-ever impeachment complaint filed vs PBBM

Pusong Pinoy Party-list Rep. Jett Nisay endorsed on Monday morning, Jan. 19 an impeachment complaint against President Marcos, the first under the latter's administration.
The impeachment complaint, which cited six arguments, was prepared by a private citizen, lawyer Andre de Jesus.
The arguments were anchored on the grounds of culpable violation of the Constitution, betrayal of public trust, and graft and corruption.
The verified complaint was received by House Secretary General Cheloy Garafil.
Nisay is a deputy minority leader and a member of the powerful House Committee on Rules. He said that the country’s president "shouldn't be above the law".
"Isa lamang po ito sa aming mga tungkulin bilang kinatawan sa Kongreso na kung saan kailangan po nami suriin, pag-aralan ang complaint na dapat dumaan sa due process at proper forum," Nisay said in a chance interview after the filing.
(This is just one of our duties as representatives in Congress, where we must examine and study the complaint, which should go through due process and the proper forum.)
What are the allegations vs. Marcos?
The arguments or allegations against Marcos cited in the 12-page complaint covered various issues. They are the following:
1. Respondent ordered and enabled the kidnapping and surrender of former President Rodrigo Roa Duterte to the International Criminal Court (ICC).
2. Respondent is unfit to serve as President due to drug addiction.
3. Respondent committed betrayal of public trust when he failed to veto unprogrammed appropriations (UA) and other unconstitutional provisions in the General Appropriations Bill (GAB).
4. Respondent engaged in graft and corruption through kickbacks and ghost projects.
5. Respondent created the Independent Commission for Infrastructure (ICI) to shield corrupt allies.
6. Respondent violated the Constitution and betrayed public trust by surrendering former President Duterte to the ICC.
The House leadership has yet to comment on the impeachment rap agasint Marcos, who in the May 2022 elections garnered a record-breaking 31 million votes en route to the Palace seat.
Endorser is a 'cong-tractor'
Nisay was among the handful of House members dubbed as "cong-tractors" by the ICI last November. The solon reportedly had links to JVN Construction and Trading.
Garafil, in a subsequent statement, said: "The Office of the Secretary General confirms that an impeachment complaint against the President, Ferdinand R. Marcos Jr. was filed today, at 8:45 a.m. at the House of Representatives."
"This complaint will be transmitted to Speaker Faustino “Bojie” G. Dy III in accordance with the Constitution and the Rules of the House of Representatives," she added.
Under the rules of the previous 19th Congress, the Speaker's office has 10 session days to refer the complaint to the plenary, which will then refer it to the Committee on Justice.
Complainant 'believes in miracles'
Asked if he was confident that the impeachment rap would prosper in the 300-plus strong House of Representatives despite the majority support for President Marcos, De Jesus said: "But then again, miracles do happen. I believe that miracles happen."
"Who knows? The numbers might end up being in our favor. Maybe members of Congress might wake up on morning thinking, hey, you know what? He has a point. Maybe we ought to exact accountability from our President," said the lone complainant.
"The fact that I had filed this complaint means that I have that modicum confidence that there are still good men and women in our government, including Congress itself...But I am confident that the House of Representatives will fulfill its duty, will fulfill its mandate, specifically as regards impeachment complaints like mine," he added.
