Workplace surveillance may seem like a simple security measure, but installing CCTV without proper disclosure can carry serious legal consequences under Philippine law.

The issue came up after Aya from MariTeam shared a story about a friend who opened a business and installed CCTV cameras to prevent employee theft.

Aya then raised the key question: “Legal po ba na maglagay ng CCTV sa opisina na hindi ipinapaalam sa mga empleyado?”

Atty. Marian Cayetano warned that doing so may violate the Data Privacy Act.

“Actually, pwede talaga siyang maging violation ng Data Privacy Act,” she said.

She explained that employers are required to inform workers about CCTV installation and may even post visible notices.

“Kailangang ipaalam ng employer na may ikakabit siyang CCTV do’n sa kanyang business at pwede ring maglagay ng notification [na nagsasabing] ‘This establishment is equipped by CCTV,’” she added.

According to Atty. Cayetano, transparency is crucial because CCTV cameras collect personal data.

“Importante talaga na nano-notify ‘yung mga tao kasi ang CCTV, nag-ga-gather ‘to ng personal data so importanteng alam at hindi nakaka-violate ng privacy,” she explained.

Meanwhile, Atty. Rafael Rivera cited the latest National Privacy Commission circular, stressing that signage is mandatory and footage cannot be stored indefinitely or shared freely.

“Kung sakaling kailangan ‘to gamitin, dapat hingin ito sa may-ari at hindi basta-basta ipo-post [sa social media],” he said.

He clarified that while business owners have the right to protect their establishments, CCTV use must always have a reasonable purpose.

“May management prerogative din kasi so karapatan ng nagnenegosyo na protektahan ang negosyo niya,” he explained—reminding employers that security should never come at the expense of privacy rights.
