ARTA to file complaints vs 131 LGUs for not complying with streamlining efforts

ARTA Director General Ernesto Perez disclosed that they will file cases against the 131 LGUs "within the week or next week."
"Mayroon pong 431 LGUs na pinadalhan natin ng notices to explain para i-explain nila kung bakit hanggang ngayon hindi sila tumutupad sa direktibang ito. Kaya you expect po na within the week or next week, sasampahan po natin ng kaso about 131 local government units (We sent notices to 431 LGUs asking them explain why they remain non-compliant with the directive. So, you can expect that within the week or next week, we will file cases against about 131 LGUs)," Perez said during a Palace briefing on Tuesday, May 6.
Perez stressed that President Marcos strictly directed all government processes to be streamlined and digitalized.
"Ito po, napatunayan natin na ito po ang pinakaepektibong paraan para labanan ang red tape at corruption in the process – marami na po tayong data that will show this (We have proven that this is the most effective way to fight red tape and corruption in the process—we have plenty of data that will show this)," he said.
According to Perez, they sent notices to explain to 431 LGUs. Out of this number, 134 did not respond.
Perez explained that LGUs should respond to a question, concern, or complaint within 15 working days from receipt under the Code of Ethical Standards for Public Officials and Employees. Failure to do so will make them liable, he said.
"[K]apag tayo ay hindi sumagot sa isang question, concern, complaint within 15 working days from receipt, liable na po sila. Iyon po ang ating gagamiting ano—hindi lang po dahil required sila ng (If we do not respond to a question, concern, complaint within 15 working days from receipt, they become liable. That's what we will use—it's not only because they are required under the)Ease-of-Doing Business Law for all local government units to set up and operationalize an electronic business one-stop shop, sinasabi rin po doon na ang (it is also stated there that the) heads of agencies, the mayors are responsible for not complying with the Ease-of-Doing Business Law," Perez said.
"At dahil hindi po sila sumagot, iyon po ang ating legal basis. Hindi po kami natatakot na sampahan sila ng demanda because we have a legal basis for it (And because they did not respond, that is our legal basis. We are not scared to file a complaint because we have a legal basis for it )," he added.
The ARTA chief further said that they will leave it to the Office of the Ombudsman to determine the possible sanctions for the LGUs involved.
"ARTA's mandate is to investigate, to conduct an investigation. And whatever finding we have, we will refer it to the Office of the Ombudsman. Ang Ombudsman po ang magdi-determine kung ano talaga iyong dapat. Dahil may violation, mayroon kang equivalent penalty (The Ombudsman will be the one to determine the appropriate sanctions. Because there was a violation, they will be an equivalent penalty)," Perez said.
