
Police Lt. Gen. Bernard Banac, commander of the Area Police Command-Western Mindanao (APC-WM) of the Philippine National Police (PNP), ordered all policemen in the area to comply with the provisions of the newly-enacted Islamic Burial Act.
The Republic Act 12160, signed by President Marcos on April 11, sets the guidelines that must be followed in burying the cadavers of Muslims, and prescribes penalties for any violation.
Banac said the law is important, particularly in the western part of Mindanao, where a large population are Muslims such as the Zamboanga Peninsula, Soccsksargen (South Cotabato, Cotabato, Sultan Kudarat, Sarangani, and General Santos City), and the Bangsamoro Autonomous Region in Muslim Mindanao (BARMM).
Among the provisions of the law are the immediate burial even without a death certificate; that the body should be wrapped in white cloth and placed in an airtight, leak-proof bag or wooden box, then sealed with zippers, tape, or bandage strips; and, prohibits holding the cadaver hostage in cases of unpaid hospital or funeral fees.
Those who would not release the cadaver which would result in the non-burial of the cadaver within the required time is penalized with fines ranging from P50,000 to P100,000.
Banac expressed confidence that the law will foster better understanding among different cultures consistent with the government program of reconciliation and unity.
“The law augurs well with the national policy of inter-faith respect and understanding especially in Southern Philippines where diverse cultures and traditions coexist among multi-faith communities,” said Banac.
