“It is confirmed that the complaint against Harry Roque has been dismissed,” said DOJ Assistant Secretary Jose Dominic F. Clavano IV.

“The QC prosecutor found that there was insufficiency of evidence needed to file the criminal case” in court, Clavano said.

A copy of the prosecutor's resolution was not immediately available.

However, Clavano said that Trillanes can still appeal the dismissal of the complaint.

“The aggrieved party has several remedies to exhaust including a Motion for Reconsideration,” he cited.

Trillanes' complaint against Roque was filed last year. He accused  Roque and vlogger Banat By of making false claims that the former senator gave away Scarborugh Shoal to China during backchannel talks in 2012.
