Marcos signs memorandum issuing Safe Conduct Passes to amnesty applicants

President Marcos has signed Memorandum Order (MO) No. 36, authorizing the National Amnesty Commission (NAC) to issue Safe Conduct Passes (SCPs) to amnesty applicants.

In his speech at the 6th Infantry (Kampilan) Division, Philippine Army, Camp BGen. Gonzalo H. Siongco in Datu Odin Sinsuat, Maguindanao Del Norte, on Friday, April 11, the President emphasized the importance of unity and healing in the nation.

"Marami na po tayong pinagdaanan bilang isang bansa, ngunit ang isa sa pinakamalungkot na yugto sa ating kasaysayan ay ang labanan ng Pilipino laban sa kapwa Pilipino (We have gone through a lot as a nation, but one of the saddest chapters in our history is the fight of Filipinos against fellow Filipinos)," he said.

"Kaya ngayong araw na ito, muli nating pinatutunayan na mas mangingibabaw ang pagkaka-isang-lahi (So today, we once again prove that unity as a race will prevail)," he added.

"Ang mga Safe Conduct Passes na ito ay hindi lamang magbibigay ng proteksyon sa mga aplikante ng amnestiya laban sa pagka-aresto, pagkakulong, at pag-uusig (These SCPs will not only provide protection to amnesty applicants against arrest, imprisonment, and prosecution)," he said.

"Higit sa lahat, ito ay isang paanyaya sa lahat ng rebelde na ihinto ang armadong pakikibaka (Above all, this is an invitation to all rebels to stop the armed struggle)," he added.

The President likewise described the event as the start of a new beginning.

"Ito ay isang bagong pahina upang makapagsimulang muli, isantabi ang pansariling interes, at makiisa sa pagtataguyod sa kaunlaran ng ating bayan (This is a new page to start anew, set aside personal interests, and join in promoting the development of our nation)," he said.

"[Ito] ay patunay na handa ang inyong pamahalaan na mag-abot ng kamay sa sinumang nagnanais magbalik-loob sa batas at sa ating lipunan (Our signing is proof that your government is ready to extend a hand to anyone who wishes to return to the law and our society)," he added.

According to the President, he recognizes the challenges faced by those who want to live peacefully but are hindered by pending cases. He assured them that the government is open to those who want to change.

"Bukas po ang aming pinto (Our door is open)," he said.

"Kung taos-puso ang inyong pagbabago, handa ang pamahalaan na makinig, umalalay, at sumuporta sa inyong pagbabalik-loob (If your change is sincere, the government is ready to listen, assist, and support your reintegration)," he added.

Marcos called on all concerned agencies to recognize the SCPs that would be issued.

Based on the MC, the NAC shall issue SCPs to amnesty applicants who are not under detention and have manifested their desire to surrender to apply for amnesty.

The SCP shall grant its holder protection from arrest and prosecution for crimes punishable under the Revised Penal Code and special penal laws, specifically those committed crimes in pursuit of their political beliefs, whether punishable under the said laws.

It also provides authority or conformity of prosecutors to motions for suspension filed by SCP holders. It also suspends any reward for the amnesty applicants' capture.

However, SCP holders shall not be released from detention pursuant to a valid arrest warrant. They are likewise not allowed to carry loose firearms or ammunition.

The MC likewise states that the possession of an SCP does not automatically confer amnesty to its holder.

Under the MC, the NAC is authorized to impose other conditions and limitations on SCPs as deemed necessary. It may also issue provisional SCPs valid for 15 days.
