Manila 3rd district Rep. Joel Chua said Monday, March 10, that the trial will still be conducted "unless of course her presence will be required" at the international court based at The Hague, Netherlands.
Chua's pronouncement came amid rumors that the warrant of arrest against the former president would be out soon, and that the Vice President was expected to be among the respondents in the ICC case.
Chua said there might only be some "problems" or "delays" should the impeached Vice President need to attend the ICC hearing.
"Kung kinakailangan ang kanyang presensya doon, siguro magkaroon ng problema (If her presence is needed there, then there might be some problems)," he said in a press conference.
"Kasi kung wala naman po sya, kung di naman po sya uma-attend [sa Senate impeachment trial] eh pe-pwede po kasi nakalagay po sa rules na e-enter po na not guilty. So pwede pong tumuloy [ang impeachment trial] pa rin po unless sya mismo yung kailanganin namin (I think it's still okay if she doesn't regularly attend the Senate trial because her side will basically say she is not guilty of the charges. So, the impeachment trial may still proceed, unless her presence is really required)," he said.
If that happens and the Vice President is unavailable for the impeachment trial, then a judicial affidavit might be asked from her camp, Chua said.
The lawmaker bared that the House prosecutors will convene on Tuesday, March 11, to discuss their plans if ever the Vice President would be needed at The Hague.
He also believed that Duterte's camp would use the possible arrest warrant as a way to escape from the impeachment trial.
"Kasi ngayon nga pong walang ICC, marami pong finafile na kung ano ano yung kabila na sa aming paniniwala ay mga legal maneuverings (Because even now that there is still no arrest warrant from the ICC, they are already doing lots of things that we believe are legal maneuverings)," he said.
"So kung magkakaroon ng ganito, I'm sure gagawa nananaman sila ng mga another legal maneuverings (So if an arrest warrant will finally be out, I'm sure they will resort to other legal maneuverings)," he added.
