Probe on social media creators 'must not suppress dissent, silence critics, restrict discourse' -- CHR
The Commission on Human Rights (CHR) underscored the need for "safeguards" and "protection" of the rights of content creators in social media and other platforms as the House of Representatives conducts hearings on the proliferation of disinformation across the internet.
"Addressing the persistent issue of disinformation requires a balanced approach -- one that upholds free expression while fostering an online environment rooted in truth, accountability, and respect for human rights," the CHR said in a statement.
"The discussions should be anchored in human rights standards to prevent any perception that the inquiry is being used to suppress dissent, silence critics, or restrict democratic discourse," it said.
The CHR said that in the modern age, social media and other digital platforms have become an emerging form of media, and digital content creators now have a role in shaping public discourse.
But with this recognition comes the responsibility to "safeguard" against disinformation and promote responsible content creation, it pointed out.
This is why the House committee hearings seek to evaluate existing laws and policies governing online spaces and explore legislative measures to ensure Filipinos’ access to accurate and reliable information, it stressed.
The CHR noted that the inquiry, being in aid of legislation, presents an opportunity to refine ethical frameworks in the digital space while ensuring that mechanisms addressing harmful content remain in place.
On the other hand, the CHR acknowledged the concerns raised by content creators before the Supreme Court regarding the implications of such legislative action since their freedom of speech and expression might be impacted.
"Any proposed framework should complement -- not override -- the existing laws and mechanisms, thereby ensuring that due process and the rule of law remain paramount," the CHR said.
"In this regard, it is expected that the nature and scope of content creation work will be thoroughly discussed between lawmakers and the invited resource persons. CHR emphasizes the need for objectivity, impartiality, and respect for the rights of all resource persons participating in these hearings," it also said.
The CHR suggested that the committee hearings take cognizance of of the ethical and professional standards upheld by the Kapisanan ng mga Brodkaster ng Pilipinas (KBP) and the National Union of Journalists of the Philippines (NUJP) and use these as "parameters" on responsible content creation.
