DOH welcomes SC order to return P60-B excess funds to PhilHealth

The Department of Health (DOH) on Friday, Dec. 5, welcomed the Supreme Court’s (SC) directive ordering the return of P60 billion in excess funds to the Philippine Health Insurance Corporation (PhilHealth) through the 2026 national budget, saying the ruling reinforces efforts to strengthen the country’s health-care financing system.
DOH Secretary Ted Herbosa expressed the department’s appreciation for the High Court’s decision, emphasizing that it supports the full implementation of the Universal Health Care (UHC) Act.
“We thank the wisdom of the Supreme Court on the questions raised about health financing,” Herbosa said.
He stressed that the DOH and its attached agencies remain committed to ensuring that PhilHealth is equipped with the resources needed to sustain reforms, especially as the agency continues to expand benefit packages under UHC.
Herbosa also noted that the department is awaiting further legal guidance on the matter.
“We await the advice of the Solicitor General on subsequent actions to take,” he added.
The Supreme Court ruling directs the national government to restore the P60 billion in excess premium contributions previously reverted to the Treasury, allowing the amount to be appropriated back to PhilHealth under the 2026 General Appropriations Act.
